HARRISBURG – Legislation authored by state Rep. Kristin Phillips-Hill (R-York Township) that aids in prosecution of identity thieves has been signed into law as
Act 60 of 2018.
“When I first started working on this bill, I was asked why this legislation was necessary,” Phillips-Hill said. “Possessing these devices was not illegal at the time, even though they have no use other than for criminal, deceitful and deceptive purposes. My legislation gives law enforcement one more tool to use in prosecuting these thieves.”
Phillips-Hill’s bill brings Pennsylvania in line with 30 other states that have enacted similar legislation. Anyone convicted of using or possessing a scanning or skimming device now faces a third-degree felony for a first offense and a second-degree felony for a second or subsequent offense.
“This new law strengthens Pennsylvania’s Crimes Code in dealing with an act that can be costly for consumers and businesses alike,” she added. “It will hopefully serve as a further deterrent for criminals who want nothing more than to steal someone’s identity and disrupt our lives for their own benefit.”
“Our goal is to protect consumers,” said Alex Baloga, president and CEO of the Pennsylvania Food Merchants Association. “We are doing everything we can to combat credit card skimming. It’s a long-standing fight and we have several partners. We will continue to do all we can to increase awareness. This legislation is a step in the right direction.”
Act 60 will take effect in 60 days.
