HARRISBURG – Gov. Tom Wolf has signed into law
House Bill 17, legislation authored by state Rep. Marcia Hahn (R-Bushkill Township) that gives parents the final word in substance abuse cases involving their children. The legislation becomes
Act 47 of 2018.
“I sponsored this bill because I firmly believe parents and guardians should have the final say in treatment decisions that involve minor children in their care,” Hahn said. “It’s unfortunate this bill is so badly needed with the number of drug and alcohol abuse cases we see these days. I’m glad the language is now in place and thank the governor for acting quickly.”
The new law amends the Drug and Alcohol Abuse Control Act to allow a parent or legal guardian to provide consent over the objection of a minor with respect to furnishing medical care or counseling related to diagnosis or treatment of substance abuse. It does protect the patient’s rights in that anyone providing medical care may only share with the parents information that would reduce the threat of harm to the minor.
Act 47 will take effect in 60 days.
