HARRISBURG – State Rep. Jim Struzzi (R-Indiana) loves Pennsylvania’s wealth of recreational opportunities. His concern lies with what he believes is the need to do a better job when it comes to protecting some of the individuals who feel likewise and are simply trying to make things better for their communities.
“We have volunteer groups who are interested in contributing to the betterment of their surroundings but run the risk of litigation against them when accidents happen,” Struzzi said. “These well-meaning individuals deserve the same protections that the landowners on whose property there are working enjoy.”
Struzzi has enlisted the help of House colleagues from not only across the aisle but around the state in authoring
House Bill 1694, legislation that would extend the existing limited liability protection enjoyed by landowners to volunteers, volunteer organizations, and those who the landowner invites onto their property.
“Under the original Recreational Use of Land and Water Act (RULWA) of 2018, landowners who make portions of their property available to the public for recreational purposes are protected from litigation under limited liability,” said Martina White (R-Philadelphia), who also serves as majority caucus secretary. “The people whose passion it is to assist with improving and sustaining these valuable assets deserve the same level of shielding from legal action.”
Reps. Mike Driscoll (D-Philadelphia) and Perry Warren (D-Bucks) are signed on as prime co-sponsors for Struzzi’s legislation, which is being circulated throughout the House for further support.
“The levels of outdoor activity increased significantly as a result of the COVID-19 pandemic and there are no signs of this trend letting up,” added Struzzi. “These community-oriented volunteer groups have worked harder than ever to keep up with the added strain on our outdoor areas, which makes this a fitting time to introduce my legislation. I’m also hoping that, as an added bonus, House Bill 1694 will plant a seed and result in even more volunteer participation.”
