HARRISBURG – Legislation by Rep. Seth Grove (R-Dover) to simplify Pennsylvania’s tax code to ensure mobile telecommunication consumers aren’t subject to double taxation was approved by the House on Monday.

“My legislation, House Bill 994, would exclude the sales of telephones, telephone handsets, modems, tablets and related accessories, including cases, chargers, holsters, clips, hands-free devices screen protectors and batteries from being subject to the gross receipts tax,” Grove said. “A recent interpterion of the current law left the items open for possible double taxation. This bill would prevent it from happening.”

The Commonwealth last updated the definition of mobile telecommunication in 2002. In those 15 years, communications technology has advanced yet the state’s classification of mobile telecommunications has remained unchanged. My legislation, House Bill 994, brings the definition up-to-date with technological advances.

Grove’s bill modifies the definition of mobile telecommunications to mirror definition used under the Sales and Use Tax. This change not only creates uniformity within our tax code, but clarifies an outdated part of the code.

“These definitions are important as it defines the scope of what is subject to the state’s gross receipts tax, which means the Department of Revenue cannot unilaterally decide to increase taxes on you, the consumer,” Grove said. “This bill provides a clear definition of what projects are subject to the gross receipts tax and are subject to the Sales and Use Tax.”

The bill now goes to the Senate for consideration.
